Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you and Zanforge LTD, a company incorporated in the Republic of Cyprus (registration details available at [email protected]), trading as Serplet ("we," "us," or "our"). By accessing or using the Serplet website at serplet.com and our SERP tracking service (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Serplet provides a search engine results page (SERP) position tracking service. The Service allows you to:

  • Create campaigns to monitor keyword rankings across search engines.
  • Track daily position changes for your domains.
  • Organize keywords with tags and view historical analytics.
  • Export ranking data for external analysis.

3. Account Registration

To use the Service, you must create an account and be at least 16 years old. You agree to:

  • Provide accurate and complete registration information.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorized use of your account.
  • Accept responsibility for all activity that occurs under your account.

You may not create accounts for automated or bot usage unless explicitly authorized by us.

4. Billing and Payment

Pricing

Serplet uses a pay-per-query pricing model. A free allotment of queries is included each month at no charge. Current pricing and query allotments are displayed on our website and within the Service. We reserve the right to change pricing with 30 days' notice.

Payment Processing

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for query credits purchased through the Service.

Refunds

Query credits are non-refundable once consumed. Unused prepaid credits may be refunded within 14 days of purchase upon written request to [email protected].

EU Consumer Right of Withdrawal

If you are a consumer in the EU/EEA, you have a statutory 14-day right of withdrawal from digital service contracts. By purchasing query credits, you explicitly request that we make those credits available to you immediately. You acknowledge that once credits are consumed, your right of withdrawal is waived in respect of those consumed credits, in accordance with Art. 16(m) of EU Directive 2011/83/EU. Unused credits remain eligible for refund within 14 days of purchase as described above.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or extract source code from the Service.
  • Scrape, crawl, or use automated tools to access the Service beyond the provided API.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Share your account credentials with third parties.
  • Exceed your plan's rate limits or attempt to circumvent usage restrictions.

6. Intellectual Property

Our Property

The Service, including its design, code, features, and documentation, is owned by Zanforge LTD (trading as Serplet) and protected by intellectual property laws. Nothing in these Terms grants you ownership rights to the Service.

Your Data

You retain ownership of the data you input into the Service (keywords, domains, campaign configurations). You grant us a limited license to process this data solely for the purpose of providing the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

We take reasonable measures to protect your data but cannot guarantee absolute security. You are responsible for maintaining backups of your data where appropriate.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we aim to provide advance notice).
  • Unplanned outages or technical issues.
  • Third-party service disruptions (search engine API providers, hosting).

We are not responsible for unavailability caused by events outside our reasonable control, including failures of third-party search engine APIs, hosting provider outages, natural disasters, or government actions.

9. API Usage

If you access the Service through our API, you agree to:

  • Respect all rate limits and usage quotas.
  • Include proper authentication in all API requests.
  • Not redistribute API access to third parties without authorization.

We reserve the right to revoke API access for violations of these Terms.

10. Limitation of Liability

To the fullest extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind.
  • We are not liable for indirect, incidental, special, or consequential damages.
  • Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

SERP data is sourced from third-party search engines and may not be 100% accurate. We do not guarantee the accuracy, completeness, or timeliness of ranking data.

11. Termination

By You

You may close your account at any time through your account settings or by contacting us at [email protected].

By Us

We may suspend or terminate your account if you:

  • Violate these Terms.
  • Engage in fraudulent or abusive behavior.
  • Fail to pay outstanding fees.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to conflict of law principles.

Disputes shall be resolved as follows:

  • (a) EU/EEA consumers: You may bring claims in the courts of Cyprus or in the courts of your country of residence. Nothing in these Terms prevents you from exercising any mandatory consumer rights you have under the law of your country.
  • (b) All other users (B2B and non-EU): Disputes shall be resolved by binding arbitration under the Rules of the International Chamber of Commerce (ICC), with the seat of arbitration in Nicosia, Cyprus, conducted in English.

14. EU Consumer Rights

If you are a consumer in the EU/EEA, nothing in these Terms limits or excludes statutory rights you have under the mandatory law of your country of residence. In case of conflict between these Terms and your statutory consumer rights, your mandatory rights prevail.

15. Severability

If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
